Enhanced Investigation of Suspected Employee Misconduct
This service offers impartial investigations of suspected or alleged employee misconduct for which forensic examination of electronic resources, surveillance, etc. will be necessary.Available to non-component districts (and component districts that participate in Level 1).
May include:
- Initial consultation upon discovery of the potential need for an investigation
- On-site investigation to obtain background information, gather physical evidence and interview potential witnesses
- Assistance in the determination of the need for the involvement of law enforcement
- Forensic evaluation of equipment such as a computer, cell phone, or internet use (this will be done by outside professional consultant)
- Written report on the results of the forensic examination
- Establishment and maintenance of a chain of custody for evidentiary items
- Surveillance of employee (workers' compensation claims, employee absences, etc.)
- Assistance in the development of counseling memoranda, disciplinary charges against employee and Part 83 reports for certified staff members
- Participation in a confrontation conference with the employee (with union representation)
- Testimony at a disciplinary hearing
- Development of a last chance agreement, employment separation agreement or a disciplinary settlement
